looking at the recent trend i am not so sure if dems are going to do anything on CIR anyway, MA senate race is more like a referendum to president and congress policies, if president or dems think otherwise they are making a huge mistake, time to push aside health care reform and concentrate on economy and jobs, any immigration reform bill in this economy is not going to happen, i hope they do something to revive the economy!

I received my H-1B approval for one year but my I-797 arrived without an I-94....
The notice also states that approved I-129 has been sent to Hyderabad Consulate upon request.
Can someone provide some insight on how to proceed and what are the options? Is there a chance to obtain authorisation by re-entering through a POE? What does this mean to my future in the states. Please clarify.
You need to leave the US and return showing the new approval notice. You may be able to just go to Canada or Mexico (depending on those countries' immigration rules) and return showing the old H-1B visa and the new approval. You should do this ASAP because you have been out of status for quite a while now.

In my case my application was filed on 2nd July but my attorney asked me to send the email on 3rd July just for records.

When I look back at the timelines, when we applied for the 485s, we thought he was in status but afterwards, we realized he might not have been. Since then, we have renewed the H4 twice, and each time there was an I94 attached and the last one is still valid, so he is in status now.
My concern is (1) that when the time comes to adjudicate his 485, someone might look back and say err, ten years ago there was a problem... I hope it won't happen, but I just want to be safe and my understanding is that returning with a stamped H4 would cure this and (2) that if we decide to go for the stamping, whether someone in the embassy would dig up the records and cause us problems.

Since you already got H4 extensions with attached I-94s, current status is not an issue. The issue will be with his I-485 application as he was out-of-status when it was applied. You should try and go to the US consulate outside US and get a H4 stamped. In my opinion, getting new VISAs will not be an issue since it was an honest mistake on your part and as soon as you realized it you applied for extensions and you should acknowledge it in your visa application. You have to get this done before USCIS issues an RFE asking for your son's status information. For how long was your son out of status. The duration of invalid status has different implications. In any case, before leaving US, you should take advise from a good attorney. Once your son gets H4 visa stamped and re-enters US on a valid H4 status, his previous out-of-status issue will be void. Please note that re-entering on AP does not void earlier out-of-status.

Even my case is similar. I requested my attorney to file my EAD and AP along with I-485 at the same time. But they did not apply for EAD and AP and but instead just filed I-485. Now they are saying they can't file for my EAD and AP until they get the I-485 receipt notice. What a mess??? Now I've pay lots of amount for EAD and AP. By the way my attroney is Murthy Law Firm. I bet yours would be the same
Actually my attorney is not Murthy. It's my employer's attorney, and they are pretty good. It was a company decision not to file EAD/AP since we were sure at that time our application will get rejected. It was just a mean to get onto the lawsuit beneficiary.

I listened to President's speech last Monday on immigration.But,he did not mention anything about legal immigration issues. I think ,we should send a memorandum or mass letter from each members of IV to the President.
We should communicate our problems. If everybody sends letter to the IV Team and they can submit all the letters to the President's Office. What do you think ? Any comments ? Is there any better way of communicating to the President ?

Since you applied for H1 extension it means that you are out of parolee status
and on H1 again.
Get visa stamping next time when you go for home country and come on H1 instead of using AP.
Use AP only if GC is approved when you are outside of country..

If she is here on H4 and while she was here her H1B got approved then there is no problem. As H1B is not VISA and its intent to hire. Infact if she wanted to to Join work on H1B, she will need to apply status change application for H4 to H1B.
This is wrong...once the H1B approved the status automatically changed. If you are not paid in H1B, you are out of status. The only way to correc the status is getting paid, pay the tax and get W-2 as like anyother person.
H1B is not a vsia intend to hire. As you are not able to find a suitable american for the job, you are hiring a foreigner with speciallity skills. Means already you have a job for the person you are sponsoring.

Both I and my wife had LUD update on Jan 9th. We got an RFE for her (but not me), asking for evidence regarding the bona fides of marriage. It will be great if you can share your experiences on RFE with us.
Here is what USCIS specifically requested:
1. Birth certificates of children
2. Documents of joint ownership of property such as car title, house (grant deed or rental agreement), etc.
3. Joint income tax returns
4. Joint financial accounts such as bank statements
5. Spousal insurance coverage such as health insurance and life insurance
In my original application, I had submitted the marriage certificate (in English) from India. I can resubmit that.
Things that I plan to submit:
a) Marriage certificate from India.
b) Joint US income tax returns for 2006.
c) Joint bank statement.
d) Kaiser health insurance for spouse.
e) Joint credit card statements.
We do not have kids. No car title or house on joint name. No rental agreement or utility bills on joint name. We do not have life insurance.
Please let me know if these documents sound reasonable enough to convince USCIS. If there is anything else that I can provide, please do let me know.

Here is what USCIS specifically requested:

I am not sure if my previous employer will support, even i am not sure if they have sent a I-140 cancellation request to USCIS.
Can i file 485 through my current employer based on previously approved I-140 as my current I-140 has priority date recapture request.
If your former employer will not support your GC application and you are not even sure if they already cancelled your 140, then you CANNOT file 485 based on that 140.
As chennai already advised you may have your 140 premium processed.
However, reading back your origiinal post I don't think you can file 485 until your new 140 is approved since you are porting PD. So your PD must be ported to the new 140 successfully and the PD current before you can submit 485. Sorry for the initial confusion.
