as gc28262 has indicated, that proper analysis and the correct interpretation of the law is needed to change such matters. Unless, EB3 people come out of the lethargic content/self pity and start working on the issues as if their life depended on it (it does) - just writing to the senators and representatives will not help. The legislative offices is not going to do the analysis (in the time that matters to us) and address it to the USCIS. However, if we do the ground work and then approach them, we may have a better chance of succeeding.
Whenever EB3 asks for writing to senators and congressmen, EB2 folks will discourage, but when Eb2 wants to write to the same group everyone encourages.
Why is this pathetic response to a Eb3 guy.
Please remember prior to BackLog days there was not much difference in time span for getting a GC and Employers wanted to cut back on paper process and used to file in EB3 only.
SO please never say High caliber as EB2. there are highly experinced and excpetionaal guys in EB3, but due to Employers negligence and bad luck they are in EB3.

Well, you assume family members can get AP and EAD after submitting I-485. Not true for many people. Take myself as an example, I was not lucky enough to file my I485 in 2007. So with a PD of early 2007, I have none of the benefit from AOS at all.
Although for me it's not a big deal because my wife will soon get her PhD and will file for her own immigration petition. This actually works better for us, because it will make the line much shorter and both of us will get the green card much quicker.
However, for those who do not work and solely depend on their spouses to get green card. This change can spell disaster for them during the long wait caused by retrogression without the ability to file AOS.

I used AVR (Automatic Revalidation Rule) to get back to US. If u have an expired stamp and a valid I-797, u can show ur PP alongwith original 797 and they'll let u in. But if u have used AP to re-enter before, u will need to use AP to enter US after ur landing. That being said, I know atleast 5 cases in the recent past who came back to US successfully using AP after their Canadian landing. I agree its a risk but most of the cases cud be hear-say. Just act innocent and that u dint know about the risk if at all u get questioned. Again, when the law permits u, why shud they question? Also, u still dont have ur US GC in ur hands...so let them know of it in a nice way if they harass u. Tell them that once u get ur US GC u will give up ur Canadian PR.
It is easier said than done. When you are entering you are at the discretion of IO and you do not know all the laws. In this particular case, the people tried to convince IO that they were planning to let canada PR go once they receive US GC but the IO was determined to revoke their AOS. So there is nothing really you can do at that point in time.

Who said ? Lawsuits will not work. If you guys have any doubts ? Follow the links below, iam gonna paste. It will tell you how powerful lawsuits are in this country if you think you have been fooled over and over on false promises. This is especially true in the case of People whose priority date was current for a long time but still they were made to wait because of unknown reasons by USCIS while the folks who had priority dates as recent as 2006 walked with Green Cards. People especially who fall under this category are sure to succeed only by filing lawsuits. I dont see any other way out here.

Your Comment on H2B is only right about H2B and doesn't apply on EB green cards. We are people who came on H1B & our Green Cards were sponsored by US employers, we have our Labor & I-140 approved and we are waiting for Visa number assigned to our applications. So you could be comparing apples to peaches...Immigration policies had been hostile in past 12 years and will continue to be same indefinitely...Now our choice is sit back, lie low, keep watching & read Visa predictions indefinitely- may be another decade or 2- or take some steps, which I think, are not going to face much opposition. Also regarding reason behind so many Indians is, that 200K H1B between 1999 and 2002. Even if visa cap is lifted for 2 years that big hump will be crossed, it may smoothen the Visa allocations for Indians.
One thing that everyne needs to understand is that before the lawmakers, etc., take a stand they study the issue.

If IV has any plan to remove the unfair 7% quota by either lawsuit and/or lobby, I will donate $ 200 as well.

It is beyond my comprehension why should we scared of initiating a litigation against the US government when it is clearly involved in blatant discrimination. The HSMP rules were challenged successfully by Indian high skilled workers in UK, why can't we do the same over here? I pledge to donate USD 200 for a lawsuit if such an action is initiated.

My wife got EAD approved on 16th Aug and I got my approved today. I do not know why 10 days of delay.
One thing I noticed is within last week or so, lot of people are receiving EADs and I485 processing is slowed down. I think now they are concentrating on EADs and come sept they will again jump to 485s. Just a guess!

In ideal situation Desi employer should provide value rather than just scrape money as revenue sharing mechanism.
If a desi employer can go and get projects and becomes preferred vendor, he would not even do H-1s. He will use a Sub. Believe me H-1B visa is a pain in the ass even for the employer too.

We filed our application on 5/31. Reached USCIS on 6/1.
Our attorney office informed us some of checks got cashed for some of us( whose 140 is pending not yet cashed) but still none of us received notice letter. Those who got early receipts may be lucky. But I think 3 weeks are reasonable. Since we are current for next month also we no need to be panic on receipts.

Honestly, I don't see why NumbersUSA would use our information to develop a counter attack. What we want is straightforward and should be straightforward. Everyone knows who are the senators who listen to our lobbysts. Don't worry with that. Trying to fight against the desire of the American people and sneak in provisions on our behalf is not working. If NumbersUSA is comprised of 200,000+ very active members, chances are they will demolish us every time if we try to go against their desire. This is not like passing the 80's amnesty anymore. The Internet out there has proven to be a very powerful democratic tool on this. If you add provisions there such as temporary increase in visa numbers (enough to take the GC applicants veterans out of this mess) and similar modest proposals which do not increase the number of greencard significantly and coordinate with NumbersUSA, then we may succeed. Believe me I called IV members when this organization was created to explain this, but no one gets it. Persuading certain lawmakers to come up with the proposals on our behalf is the easy part. AILA has been doing this for a long time anyway. As long as you have the money and connections to do so. I am not taking the IV merit away. I do give them credit for organizing the structure and collecting the resources. However, this is not about credits or discredits. Think about it and figure out who actually blocked S.2611/1934 last year. Hint:It was not lawmakers. Note that we should try to come up with provisions enough to minimize the greencard waiting times, not making the priority current for everyone, although that would be obviously ideal.
It is a reality that you don't like to hear:The American people, in a way represented by NumbersUSA, are the bosses on this. Trying to fight against is really hard. You need to gain their sympathy instead.

I sent my 485 to NSC on JUL 3rd, my 140 approved NSC, no receipts from
TSC yet. Does any body got receipts who applied on JUL 3rd...?
If your 140 Approved from NSC then you should get receipts from NSC. Not from TSC.
