    My 485 application was filed with NSC on June 4th, 2007. I know it is too early to expect receipt notice.

    Who will receive the original approval notice?. Attorney or me?. Who will receive the FP notice?.

    I feel for the guys who have been waiting since 2001 for their green cards in the EB3-I/C category.

    To change the interpretation of how spillover is applied, you will need a better argument than "The system isn't fair."

    Why should the USCIS/DOS favor EB3 over EB1 or EB2? Unless you provide a reason that benefits America, no executive or law maker is going to touch this. You can see why this is a tough argument to make - The USCIS sees EB1 as better educated and more accomplished on average than EB2 and the same for EB2 over EB3. Are there exceptions to the rule? Ofcourse there are. But the law is designed to solve the most common scenario and not complicated situations like this.

    EB3 to EB2 isn't a slam dunk as many of you have correctly pointed out. One option is to move employers and find the right employer who is ready to file for EB2. While that may not work for everyone, it is the only known way out of the EB3 nightmare.

    I support measures that will alleviate your pain although this will likely not benefit my personal situation. Visa recapture is a real possibility at the end of this year - I recommend you support IV to accomplish this goal.

    Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.

    May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

    What is the difference between the two? IMO, two words "Effective Marketing". Come on, where are the MBA's among us who can offer strategy? Actually I feel we are so backward that we don't even need MBA's to improve from here, just any simple ideas

    I respectfully disagree. It has nothing to do with marketing, fraud desi companies put up free ads on sulekha, its the mindset of a large number of our audience we are missing and need to account for. maybe it has to do with jugaad/kludge - the goal defines the means (loosely).
    Of course many of these expectations cannot be satisfied in a honest non profit.

    All the appropriations bill will be dealt by the new Democratic Congress in Jan-Feb (CR expires Feb 15). Immigratio Relief provisions can be attached to these bills...i believe there is widespread support for these among both Democrats and most Republicans

    so from the above post it is obvious Sen Menendez will consider a recapture provision only as part of a comprehensive bill. Atleast you got an email that addresses your expressed concern about backlogs. I just got the standard reply for DREAM Act, even though I had specifically spoken about LEGAL immigrants-

    There is very simple reason for this, during 1999-2002 H1B cap was raised to 190,000 even if you make a guess on the lower side more than 50% of these H1Bs went to Indians, so atleast 200,000 Indians entered US between 1999 when these people filed their Green Cards most of them filed under EB-3, b'cause retrogression wasn't there and everthing was current, lot of people, who were in the states where labor took less time, kept getting their green cards, in the meantime a huge chunk of people from states like NJ, NY, TX, CA got stuck at the labor stage with PD in 2000 and up. So basically lot of 2002 & above got cleared but these people with older PDs were stuck. Now when these Labors are cleared, with just 3300 Green Card numbers every year, it'll take 20 years or more for EB-3 cut-off dates to move to 2009.

    But even if it was 65000, from India, I'm sure most of them took a big slice, lets say 30%= 20,000 H1 visas. And did the 7% quota formula might have existed at that time too. If so, even then there must be quite a big line. Why were things current at any point. Were they just processing very fast without any attention to quota formula and then they woke up?

    We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that don�t have our finger prints in file. I never got any notice and my lawyer said they don�t need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 � 15 business days more. Our current EAD were expiring soon and I called congresswoman�s office next day. Got the approval email yesterday evening. Don�t know what worked. But what a huge relief.

    I-140 approved � Jan 2007
    I-485 applied � June 2007
    EAD (Renewal) applied � May first week 2008
    Called USCIS and Opened SR � August first week

    I have to say, no matter how reluctant I am, that I am pretty depressed about the whole green card thing. I have always tried to have a positive attitude and I definitely know that there are a lot of things much more important than green cards. However, I do feel the emotional toll of green card retrogression. Maybe admitting, instead of denying, of the frustration, depression, and even anger is better and may help face it up.

    I came on extension. I think they are more critical about the companies with whom you are working for. All my friends with extended their visa with no problems. I it is very hard to conclude on this. But scares every one if we keep saying they can not extend their visa.
    Be prepared with good documentation and you should be fine.

    Following is an e-mail I received from a person on L-1 with IBM.


    Adding to my conversation with you, its unfortunate that my L1 extension has just got denied this week. I was going to leave this company anyways but this makes the COS difficult. My case took unusually long and now finally i have the denial notice as per USCIS website. My company has not yet received the papers, but once they do i may have to go back to India for converting my status. I think cannot go to Mexico or Canada as my I-94 has expired.

    In the meantime i am following a lead i have for a project in Atlanta. Nothing sure but i will let you know if it culminates to something.

    I was also informed that there is a new rule in place which does not allow people to go to Mexico or Canada for H1 stamping if they have entered US on a different visa . People are being sent back to home country for stamping.

    What do you suggest i do? Shall i get H4 stamped in India or shall i go for H1 stamping. I will still have at least a month's grace period and if things don't work out after i come back, i will then convert to H4 then.

    If that was all that easy, I am sure Pres. Fox would hire 3,000,000 telemarketers to call Senators from Mexico and put a request pro amnesty on daily basis. Somehow it is obvious that the person calling or supporting CIR typically have vested interests on that; I think when one detects that direct beneficiaries of amnesty - not an US person - are campaigning, lawmakers probably they tend to ignore that.

    Sen. Specter is just going to have his ears full. I can imagine what angry US citizens could tell him on those hearings. If CIR passage depends on positive feedback from those hearings, it is going to be tough. I am sorry to tell you, but I have been talking to many Americans on this. Hearings will just bring the truth to the surface, and that means border enforcement, less immigration, illegal and illegal.

    Regarding feedback from the public on skilled legal immigration, read the article below. Then go to "Discuss" and see what Americans are saying about us. They are making a tough point that in these inevitable times of offshoring, we are coming here to take away jobs that are left.
