For most of the jobs, employer must accept any worker who is authorized to work in the US. In other words, US citizens, Permanent Residents (aka Green Card holders), and EAD (person authorized to work for any employer by USCIS). From legal point of view, employer can not discriminate between GC holder and EAD. If job is advertised as for Citizens only, applicant has right to ask for such reason.
Now, in order to qualify as person who has been wrongly discriminated
1. he/she must be otherwise qualified for job (example job asks for dot net and person has java experience)
and
2. he/she MUST have applied for the job.
Employer can not discriminate because of
1. Expiry date of EAD
2. Reason for Issue of EAD (I-485 based, L2 visa, F1 visa etc)
Having said that, there could be valid grounds that job is qualified only for US citizens or US citizens with specific security clearance. Applicant, in this case, has right to ask for reasons for such requirement.

Acquired Immigration-Related Extreme Depression (AIRED)
Like AIDS, it has no permanent cure for the time being.
However, like many pharmaceutical companies and research institutions involved in finding a cure for AIDS, IV is working on a project to cure retrogression (equivalent of the HIV virus that causes AIDS).
Like AIDS, there are no time lines, promises, or guarantees that a cure will be found for AIRED. However, patients report some improvements with formulations like EAD and AP. :)

Kennedy, McCain, 2 congressmen meet
By Jerry Kammer
COPLEY NEWS SERVICE
December 9, 2006
WASHINGTON Two of the most liberal members of Congress met with two of their most conservative colleagues this week to revive immigration legislation that passed the Senate but was throttled by House Republican leaders who resisted its attempt to grant citizenship to illegal immigrants.
Sen. Edward Kennedy
The plan is to bring the bill up in late winter, said Rep. Jeff Flake, R-Ariz., a conservative stalwart who attended the meeting in the office of Sen. Edward Kennedy, D-Mass. The other participants were Sen. John McCain, R-Ariz., and Rep. Luis Gutierrez, D-Ill.
The strategy session Wednesday came amid speculation about how the dynamics of the immigration debate might change, if at all, when Democrats take control of the House and Senate next month.
Flake said that Kennedy, who will be chairman of the Senate Judiciary Committee's immigration subcommittee, wants to let the new Congress deal first with issues such as the war in Iraq and proposals to raise the minimum wage.
Then he'll be ready to go with a new version of the bill that the Senate approved in April.
Sen. John McCain
Republicans ran the show in both houses of Congress then, and passionate divisions in their ranks over immigration policy became a dominant feature of the debate. Democrats, particularly in the House, were mostly content to sit back and enjoy the stalemate, even as they campaigned against the do-nothing Republican Congress.
Now Democrats face the hazards of immigration politics.
Immigration-law changes are conspicuously absent from the legislative agenda laid out by incoming House Speaker Nancy Pelosi. Observers here say it will be difficult for Pelosi, D-San Francisco, to honor her campaign-season pledge to work for a new comprehensive immigration law without splitting a caucus that includes freshly elected Democrats who vowed to secure the border and crack down on illegal immigration.
The November midterm elections seemed to send mixed messages.
Rep. Luis Gutierrez
In a cliffhanger contest, Arizona Rep. J.D. Hayworth, a conservative Republican and strident foe of illegal immigration, was defeated by Democrat Harry Mitchell.
Immigration advocates such as Ben Johnson of the Immigration Policy Center say Hayworth's defeat showed that immigration did not turn out to be the firebrand issue that some people thought it could be.
But immigration restrictionists point out that Mitchell made getting tough on immigration the centerpiece of his campaign. They also say Mitchell cleverly used the issue against Hayworth, saying his Republican opponent was part of a political regime that wasn't competent enough to stop the hundreds of thousands of immigrants that sweep across Arizona's southern border each year.
While Mitchell said he favored legal status for long-established immigrants, he insisted that immigration policy can be fixed only by members of Congress who are willing to enforce the law, produce real immigration reform and stop playing politics with the issue.
Rep. Jeff Flake
That enforcement-heavy approach is fine with immigration advocates as long as it is part of a package that provides permanent legal status to those who are beckoned across the border by agriculture, restaurant, construction, landscaping and janitorial jobs. The number of illegal immigrants in the United States is estimated to be at least 11 million.
Immigrant-rights advocates, along with their allies at the National Chamber of Commerce and other business organizations, also support a proposal to provide hundreds of thousands of low-wage workers every year for employers who demonstrate that they are unable to find Americans to fill the slots.
While McCain and Kennedy describe this as a temporary-worker program, the legislation they sponsored would put the workers on a path to citizenship.
At a time of anxiety about the loss of good-paying manufacturing jobs, the McCain-Kennedy bill's efforts to import low-wage labor has drawn the anger of critics across the political spectrum. That is why Mark Krikorian of the Center for Immigration Studies, which advocates immigration restrictions, predicts Pelosi will be reluctant to get behind a proposal that could endanger the new Democratic majority.
Nancy Pelosi knows the Democrats are on probation for the next two years, Krikorian said.
He predicted that Pelosi would back less ambitious immigration change, such as a plan to provide legal status to undocumented students, rather than take on the explosive issue of mass legalization, which critics condemn as an amnesty that would spawn more illegal immigration.
But Frank Sharry, executive director of the National Immigration Forum, which advocates for immigrant rights, argues that next year will be pivotal because of the presidential race that follows.
I think that once we hit primary (election) season, controversial issues get a lot harder to do, Sharry said. Everybody I talk to says 2007 is the window of opportunity.
Pelosi was noncommittal this week on whether the House would take up immigration legislation. She sought to deflect some of the responsibility to the White House, suggesting that she expects President Bush to offer more specifics than his call to match willing worker with willing employer.
That's up to the president, Pelosi said. We want to work closely with him because it has to be comprehensive and bipartisan.
President Bush's political advisers, meanwhile, have acknowledged that revamping immigration law may be necessary to shore up sagging support for Republicans among Hispanics, the nation's fastest-growing ethnic group. Republicans received just 30 percent of the Hispanic vote this year, down from 44 percent in 2004.

My special Thanks to Mr. Prakash and Ms Windy for raising the issue with USCIS Rep Ms. Debra Roger.
Please don't miss this chance:
Please send details to CIS Ombudsman office with scaned delivery Proof for pending applications. Please mail him all the details. He want to see the trend. No efforts are useless. Not for today nor for future.
USCIS is again not admitting that they are not following the FIFO and per USCIS, we should have got our EAD by now also. :D

Thanks buddy,
What is the procedure to the SSA update?
My family do not have SSA? I need to apply for them as well.
You can download the form from SSA website and fill the information for each applicant and take it to the SSA office. You can get rid of 'authorized to work with INS permit only' label of your SS card by using the same form and get a new card.
Take the forms, your PR card, old SS card. It just takes few minutes. They will take the info, shred the old cards, forms, etc. and will mail the cards to your address...Just check other thread ' Dos and Donts after GC' fo rmore info, and open a separate thread so as to not to mix up the original content of the thread...

I am sitting here in front of my laptop for 10 minutes, still I don't know what to say.
I am really sorry to hear your condition. I am not sure of any clause for a situation like this or may be there is.
I am neither a God to show you a way nor your friend to be next to you and help you hold your spirit high. All I got is a heart to show and give you an unconditional love and support.
I still cannot breathe after reading this. I juste prayed to God for you. Don't loose your hope. I am sure you are trying or tried all types of cures. I have deep faith in Pranayam/Yoga. I am not sure if you have heard about SWAMI RAMDEV JI. He teaches pranayam and here's link to his forum http://forums.curesearch.org/ShowPost.aspx?PostID=631 . Try to meet him if possible. Our best wishes are always with you. May God bless the family.

I know many people are averse to talking to their lawmakers because of unknown fears(totally wrong thing to do...there is nothing to be afraid of)
Come on, if you are not strong enough to talk to your congress rep and/or his staff, then you need to evaluate yourself.
Yesterday, I did talk to a bunch of office people for a congress rep who is a republican (and still evaluating CIR) and they were very impressed with my knowledge of the issues and hearings happening in the senate/congress etc. I may have moved that congress man's decision towards supporting CIR. Just get yourself acquainted with what is happening with immigration in the hearings - know who the key players are etc AND then just talk to the office people/staff dealing with immigration for the congress reps. The worst that can happen is that they may disagree with you. But they will not ill treat you in any way.
Now show some depth - contribute your time and money to IV.

Congratulations Aman on your green card.
Appreciate your feelings towards this community but personally i think IV need to have a system in place to reimburse expenses incurred towards the administrative costs, as suggested by mgos.
Atleast i think these funds we are collecting now should be directed towards an administrative expenses account for reimbursing you and all other core team IV members for the amount spent already.
Please arrange for setting up an administrative account (or should it suffice to just make the paypal contributions with a specific message saying something like "REIMBURSEMENT").
Thank you Aman & all the other immigration voice members who have spent so much time, energy and resources in advocating on behalf of all of us. I have been working in the non-profit sector for the past 8 years and from experience suggest that in order for this movement/advocacy campaign to sustain it is important for us to have a system in place where core campaign members are reimbursed for their past and recurring expenses. We have contributed to IV previously and would like to pledge $200 towards Aman's expenses.

Im really not sure if this helps EB3 cases. for example in my case i have a bachelors degree + 10 years expereince and stuck in EB3. I dont think this will help me because I dont have an US degree.
Correct me if im wrong.
That is correct, but it will help thousands of people who come on F1 visas and then transition in to H1B and have their GC being processed. I think that we need to look at what the U.S wants to get out of all this too and not just our perspectives.

hi,
folks who got their GC recently - i was wondering what the post "card production ordered" timeline looks like. How long did it take to get the GC in hand once the CPO email/LUD was received, and what other updates did you receive along the way?
thanks and good luck to all.

The answer is in your question. Numbers. A few years ago (circa 2002-) no one complained much about Indians. Recently the complaints in the media/forums etc. are much higher. Why ? More H1, => more bodyshoppers (mainly India) => more abuse => more complaints and so on.
Also FYI, H1 is "temporary" just like F1. H1 is not a guarantee to GC. So you need to go back after 6 years, since you say F1 should leave after graduation.
Yeah no one else does fraud, another anti Indian in this forum.
